1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Ophelion Software ("we," "us," "our") regarding your use of the Box Buddy mobile application ("App").

By creating an account, downloading, accessing, or using Box Buddy, you agree to comply with and be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2. Eligibility

You must be at least 13 years old to use Box Buddy. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will use the App in compliance with these Terms and applicable laws
• All information you provide is accurate and truthful

If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Description of Service

Box Buddy is a mobile application that helps users organize and track moving or storage boxes using QR code labels. The App allows you to:

• Create digital inventories of boxes
• Generate QR code labels for boxes
• Scan QR codes to view box contents
• Search and filter your box inventory
• Access your inventory offline
• Share box inventories with family members (if using family accounts)

4. Account Registration and Security

Creating an Account

• You must create an account to use Box Buddy
• You must provide accurate and complete information
• You must keep your account information up to date
• You are responsible for maintaining the confidentiality of your password

Account Security

• You are responsible for all activities under your account
• Do not share your password with anyone
• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss resulting from unauthorized use of your account

One Account Per Person

Each account should be used by only one person. Do not share login credentials with family members. If moving with family, use the family account feature instead.

5. Subscription Plans and Payments

Free Tier

Box Buddy offers a free tier that allows you to create up to 20 boxes with full functionality, including offline access.

Pro Tier

The Pro tier is available as a one-time in-app purchase and includes:

• Unlimited boxes
• All features included in the free tier
• Any additional premium features we may add

Payment Terms

• Payments are processed by Apple App Store or Google Play Store
• Pricing is displayed before purchase and may vary by region
• One-time purchases are non-refundable except as required by law or App Store policies
• We reserve the right to change pricing with notice

Refunds

Refund requests must be made through the Apple App Store or Google Play Store. We do not process refunds directly. Refund policies are governed by Apple's and Google's terms.

6. Family Accounts

Creating a Family Account

• You must be at least 18 years old to create a family account
• All family members must be at least 13 years old
• You are responsible for all activity by your family members
• You must have permission from family members before inviting them

Account Sharing

• Do NOT share your login credentials with family members
• Each person should have their own individual account within the family
• Sharing passwords violates these Terms

Data and Liability

• Family members can view, edit, and delete shared boxes
• You are responsible for backing up important data
• We are not liable for data loss caused by family members
• In case of disputes, the admin has final control over the family account
• We do not mediate family disputes

Subscription and Payment

• Only the admin can purchase subscriptions for the family account
• One subscription covers the entire family (up to 5 people)
• If the admin cancels, all family members lose premium access
• No partial refunds if family members leave

Termination

• Admins can remove family members at any time
• Members can leave at any time
• If admin deletes account, the entire family account and all boxes are deleted
• Export your data before leaving a family account

7. User Content and Conduct

Your Content

You retain ownership of all content you create in Box Buddy (box names, descriptions, photos, etc.). By using the App, you grant us a license to store, process, and display your content solely to provide the service.

Prohibited Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated tools to access the App (bots, scrapers)
• Abuse, harass, or harm other users
• Share inappropriate, offensive, or illegal content
• Create multiple accounts to bypass free tier limitations

8. Intellectual Property Rights

Our Rights

Box Buddy, including all content, features, and functionality, is owned by Ophelion Software and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Use our trademarks or branding without permission
• Create derivative works based on the App
• Remove any copyright or proprietary notices

Your Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Box Buddy for your personal, non-commercial use.

9. Data Storage and Backup

Cloud Storage

Box Buddy uses cloud storage (Google Cloud Firestore) to store your data and enable synchronization across devices.

Offline Access

The App provides offline functionality. Changes made offline are synchronized when you reconnect to the internet.

Your Responsibility

• You are responsible for backing up your data
• We recommend regularly exporting your box inventory
• We maintain backups but do not guarantee data recovery
• We are not liable for data loss due to your actions, technical failures, or force majeure

10. Disclaimers and Limitations of Liability

No Warranty

Limitation of Liability

Specifically, We Are Not Responsible For:

• Lost, stolen, or damaged items during your move
• Errors or inaccuracies in your box inventory
• Inability to locate items due to incorrect data entry
• Technical failures, including server outages or data loss
• Third-party services (Apple, Google, cloud providers)
• Actions of other users, including family members

11. Indemnification

You agree to indemnify, defend, and hold harmless Ophelion Software and our affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your content or data

12. Modifications to the App and Terms

Changes to the App

We reserve the right to:

• Modify or discontinue the App (or any part) at any time
• Change features, functionality, or pricing
• Add or remove features from free or paid tiers

Changes to Terms

We may revise these Terms at any time. Material changes will be notified through:

• In-app notification
• Email to your registered email address
• Updated "Last Updated" date at the top of this page

Your continued use after changes constitutes acceptance of the new Terms.

13. Termination

By You

You may stop using the App and delete your account at any time through the app settings. Upon deletion:

• Your access to the App will be terminated
• All your data will be permanently deleted within 30 days
• You will not receive a refund for any unused subscription period

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period
• We discontinue the App

We will provide notice when reasonably possible, but reserve the right to terminate immediately for serious violations.

14. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

Informal Resolution

If you have a dispute with us, please contact us at support@ophelion.app first. We will attempt to resolve disputes informally.

Arbitration

Class Action Waiver

To the extent permitted by law, any disputes will be resolved individually. You waive the right to participate in class actions or class-wide arbitration.

15. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, internet outages, etc.).
